New York QDROs
A qualified domestic relations order (QDRO) is a court order that assigns the right to receive all or a portion of retirement plan benefits to an alternate payee which is usually a former spouse.
QDROs need to be drafted and signed by a judge if your spouse has money in a retirement plan and you are either separating from your spouse, are already divorced, or are in the process of getting divorced. If you live in New York and are in need of a QDRO, then you need a New York QDRO attorney.
A New York QDRO needs to be drafted by an experienced and licensed attorney. Not all attorneys can or even know how to draft a QDRO. There are different laws for each state in relation to QDROs and how they are to be drafted and filed.
Once this technical legal document is drafted, it needs to be signed by the judge assigned to your case.
